COPYRIGHT POLICY
It is the policy of the FIT Library of the Fashion Institute of Technology, State University of New York to follow the fair use provisions of the Copyright Law (contained in Title 17 of the U.S. Code).  Specifically the FIT Library Reserves Policy is guided by the permissions granted within Section 107 of the Copyright Law with respect to making copies for classroom use is not considered a copyright infringement.  It further establishes four factors that will be used to determine whether the use being made of a work is fair use.
Purpose and character of the use, including whether such use is of a commercial
    nature or is for nonprofit educational purposes.
The nature of the copyrighted work.
The amount and substantially of the portion used in relation to the copyrighted work
    as a whole.  No more than 10% of the entire work.
The effect of the use upon the potential market for or value of the copyrighted work.
In its enforcement of photocopying and/or digitizing works for the purpose of placing them on reserve, in print, the FIT Library complies with these four fair use factors, and to that end adheres to the following requirements:
Course Reserves will be processed for FIT courses only.
All materials placed on reserve will be at the initiative of faculty solely for non-commercial, educational use by FIT students.
Recommended limit for FIT Library reserves: 25 items.  We ask that faculty placing materials on reserve at FIT Library limit the number of items to 25.  Staying under this limit will help us meet all requests equitably.
Material will only be make available for the semester the class is being taught.
There will be no charge for access to reserve materials; the charge for copies made by students will be limited to the nominal costs of photocopies.
Whether the Library owns the item or not, the library will not place on reserve:
An entire book,
An entire journal issue,
Amounts that exceed 10% of the work,
Works intended to be purchased by students for course work, such as textbooks,
   coursepacks, workbooks, exercises, solution manuals, standardized tests or test
   booklets or test booklets and answer sheets, and case studies,
A copyright notice will be placed on all photocopies to be used for reserve material.
FIT faculty are responsible for making the initial good faith determination of fair use and acknowledging copyright compliance when making requests to place items on reserve.
FIT faculty are responsible for obtaining copyright permissions when needed, paying copyright permission fees as requested and presenting proof of copyright permission for items requiring such permission.
Works that explicitly grant permission to copy for educational purposes will be accepted for reserves.
The FIT Library reserves the right to:
Determine if material will be placed on reserve,
Make the final determination if copyright permission is necessary,
The FIT Library will routinely monitor the effectiveness of this policy and make every,
   effort to ensure that library services are in compliance with the Copyright Law.
FAQs

What material can be placed on course reserve?
Library books, personal books, articles, book chapters, videos/DVDs.

What are the loan periods for material on course reserve?
Two hours, four hours, 1-day, 1 week.

May faculty keep personal items on Reserve indefinitely?
No, we cannot retain personal materials from semester to semester.  We will return your materials to you via interoffice mail at the end of the semester or shortly after the expiration date that you have indicated.

Faculty may resubmit personal materials for Reserve the following semester.

When to submit reserve requests?
To assure availability of material prior to the start of classes, please submit requests by the following deadlines:

Fall semester by August 1
Spring semester by December 15

When materials will be available on reserve?
Lists are processed in the order received.  Online requests processed before paper.  Since many lists are received in the first weeks of a semester, please submit your requests as early as possible to avoid delays.  Materials received after 4 pm or on weekends will not be available for two business days.  You will receive an email from the Library when your list is ready.

Please make sure your materials are on reserve before making assignments.  You can  search by your name, course name, or course number in the Reserves module in StyleCat StyleCat Logo Library Catalog to confirm reserve materials are ready for students to check out.

Personal copy 5 business days
Books purchased from FIT bookstore 10 business days
Books purchased from outside vendor 2-6 weeks or longer to order, receive & process

What to place on reserve?

 Books
Include call numbers on the "Reserve Request" form.  If a book is not available in
StyleCat StyleCat Logo Library Catalog, we will attempt to purchase it in a timely manner. 
To expedite ordering books, include publisher and date of publication, ISBN, and edition.  It make take from 2-6 weeks or longer to order, receive, and process new books for reserve.


Personal copies
You may place personal copies of books, dvds, cds, or other non-print materials on reserve.  Please note the Library will place labels and stickers on your print materials in order to process them for the collection.  To print the form to accompany your personal copy, click here.

Journal articles, chapters in books
All photocopies must fall within "fair use" (see Copyright Guidelines).  Unless you have obtained copyright permission from the author, please do not submit multiple copies of articles, photocopies of entire books, or a photocopy that is more than 10% of a complete work. 

The Library does not accept course packs or personal anthologies.  All items will have to be submitted individually.

How do I put material on reserve?
Fill out a form for each item.  Click for form to place a Library book on Reserve or get a print copy at the Circulation Desk, 5th floor.

In addition to other information requested, be sure to include your course name and course number on the form.

Indicate an expiration date for each item you place on reserve.  Items will be automatically removed from reserve at the end of each semester.
